These Terms of Service ("Terms") govern your use of medicalsuppliesforhome.com (the "Site") and your purchase of products from Medical Supplies for Home ("MSFH," "we," "us"). By using the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract under US law to make a purchase. By placing an order, you represent that you meet these requirements and that all information you provide is accurate.

2. What we sell

MSFH is an independent retailer of consumer-grade over-the-counter medical supplies. We are not a pharmacy. We do not dispense prescription medications, controlled substances, sharp medical devices that require a license to handle, or any item that requires a physician license, DEA registration, or pharmacy license to purchase. Even if you hold such a license, we are not authorized to ship such items. For prescription items, order through your registered Rx wholesaler or your local pharmacy.

3. Pricing and availability

All prices are in US dollars and are subject to change without notice. We make every effort to display accurate pricing and inventory; in the rare event of a clearly incorrect price or out-of-stock listing, we may cancel the affected order and issue a full refund. Sales tax is calculated based on your shipping address and added at checkout.

4. Cash sales only — no insurance billing

MSFH conducts cash sales only. We do not submit claims to or collect payment from Medicare, Medicaid, or any commercial insurance plan. We do not verify whether items you purchase are covered under any insurance program, regardless of prior customer history. If you are a Medicare or Medicaid beneficiary and elect to purchase from this Site, you are personally and fully responsible for payment. If you reside in a Competitive Bidding Area, Medicare will not reimburse you for competitive bid items not purchased from awarded Medicare suppliers absent certain exceptions; you will not be able to seek reimbursement from Medicare for items deemed competitive bid items purchased from this Site.

5. HSA / FSA eligibility

Many items in our catalog are eligible for purchase with HSA or FSA funds under IRS Publication 502. Eligibility is shown on each product page. The final determination of eligibility for any particular plan is made by your plan administrator. We provide a receipt for substantiation; we do not act as your plan administrator and we make no guarantee of reimbursement.

6. Order acceptance and fulfillment

Placement of an order via the Site is an offer to purchase. Acceptance occurs when we send you an order-confirmation email. We reserve the right to refuse, cancel, or limit any order, including for reasons of pricing error, inventory issue, fraud or abuse signals, geographic restrictions on the item, or because we determine the item is outside our authorized scope (for example a prescription item ordered inadvertently). If we cancel an order, we will refund any payment in full.

7. Shipping

See our Shipping policy for processing times, transit estimates, and shipping restrictions. Refrigerated and cold-chain items are not shipped to residential addresses.

8. Returns and refunds

9. Acceptable use

You agree not to: (a) use the Site for unlawful purposes; (b) attempt to access, scrape, reverse-engineer, or interfere with the Site's systems or other users' accounts; (c) place fraudulent orders or use stolen payment instruments; (d) resell products purchased on the Site without our written agreement; (e) submit false reviews or attempt to manipulate product ratings; or (f) use the Site to harass our staff or other users. We may suspend or terminate accounts that violate these terms without notice.

10. Product information disclaimer

Product descriptions, images, and specifications are provided for general informational purposes and are based on information supplied by the manufacturer or distribution partner. We do not warrant that descriptions or other content are accurate, complete, current, or error-free. Nothing on the Site constitutes medical advice. Consult a licensed healthcare professional for any medical condition or before changing the use of any product.

11. Intellectual property

The Site, including text, graphics, logos, page layout, and software, is the property of MSFH or its licensors and is protected by US and international copyright, trademark, and other intellectual-property laws. You may not copy, reproduce, modify, distribute, or create derivative works of any portion of the Site without our written permission. Product names, brand names, and trademarks shown on the Site belong to their respective owners.

12. Disclaimer of warranties

The site and the products sold on it are provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and accuracy of information. Manufacturer warranties pass through to you where applicable; we make no additional warranty beyond what the manufacturer provides.

13. Limitation of liability

To the maximum extent permitted by law, MSFH's total liability arising out of or related to your use of the Site or any product purchased from us is limited to the amount you paid us for the product giving rise to the claim. We are not liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption, even if we have been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify and hold MSFH, its officers, employees, and agents harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of: your violation of these Terms; your misuse of the Site; your violation of any applicable law; or your infringement of any third-party right.

15. Governing law and dispute resolution

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws principles. Any dispute arising under these Terms will be resolved in the state or federal courts located in Oakland County, Michigan, and you consent to the personal jurisdiction of those courts. The parties waive any right to a jury trial.

16. Changes to these Terms

We may update these Terms at any time. The "Last updated" date at the top of this page reflects the most recent version. Continued use of the Site after changes constitutes acceptance of the updated Terms.
